ON THE BASIS O F LEGAL VALIDITY8 HANS KELSEN TRANSLATED BY STANLEY L. PAULSON THE QUESTION OF THE BASIS of legal validity is the question of why one ought to behave as the law, namely the positive law, prescribes. This question presupposes that on conceives of the law as a norm or, more precisely, as a system or norms, a normative order. There are various types of norms—norms of logic, which fix the limits of thought, and norms of morality and of the law, which regulate action. Norms regulate action by commanding, permitting, or autho- rizing it.b To summarize these three normative functions in a word, " ["Vom Geltungsgrund des Rechts" first appeared in Volkerrecht und rechtliches Weltbild. Festschrift fur Alfred Verdross, F.A. Frhr. v.d. Heydte, I. Seidl-Hohen- veldern, S. Verosta, and K. Zemanek, eds. (Vienna: Springer-Verlag, 1960), pp. 157-66, and was reprinted in Die Wiener Rechtstheoretische Schule, H. Klecatsky, R. Marcic, and H. Schambeck, eds. (Vienna: Europa Verlag, 1968), vol. 2, pp. 1417-28. The translation is printed with the kind permission of the Springer-Verlag.
