Assessing the Jurisdictional Model of Topicality

Assessing the Jurisdictional Model of Topicality Debate theorists have argued that topicality is a jurisdictional issue. While the term “jurisdictional” is used freely in this context, few understand the actual implications of using jurisdiction as a model for topicality arguments. Analyzing the actual substance and procedure of legal jurisdiction, this essay argues that (1) the theory of subject matter jurisdiction is inappropriately applied to debate, and (2) the theory of personal jurisdiction implies recognition in debate practice of important procedural characteristics of the jurisdictional challenge. http://www.deepdyve.com/assets/images/DeepDyve-Logo-lg.png Argumentation and Advocacy Taylor & Francis
