Recent Developments in Adoption Law LEGAL INTERSECTIONS Recent Developments in Adoption Law James Marsh, JD Daniel Pollack, MSW, JD ASFA DECISION ESTABLISHES RIGHT TO ADOPTION OPPORTUNITIES FOR FOSTER CHILDREN Introduction Recently, a federal district judge entered a decision in the long-run- ning Jeanine B. v. Scott McCallum (2001) litigation challenging the op- eration of the foster care system in Milwaukee, Wisconsin. In an unpre- cedented ruling, the judge held that the Adoption and Safe Families Act of 997 (ASFA) creates a federal statutory right to have a state:  initiate a proceeding to terminate parental rights (TPR) when a child has been in foster care for 15 of the most recent 22 months;  at the same time, begin to identify, recruit, process and approve a qualified family for adoption; and  document any exceptions that apply under the applicable federal law (42 U.S.C. § 675(5)(E)(i)-(iii)).
